Please read these Terms of Service carefully before using MindTune. By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Agreement to Terms
By accessing or using MindTune ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
2. Service Description
MindTune is an AI-powered mindfulness meditation application that provides:
• AI-based mood detection and personalized meditation recommendations
• Guided meditation sessions with voice, binaural beats, and 3D spatial audio
• Mind metrics tracking (stress, focus, sleep, emotional balance)
• Mindfulness challenges and community features
• Progress tracking and insights
• Integration with health apps and wearable devices
• Educational content on mindfulness and meditation science
3. Mental Health Disclaimer
IMPORTANT: MindTune is NOT a medical device, mental health treatment, or therapy. The Service is not intended to diagnose, treat, cure, or prevent any mental health condition or disease.
You should:
• Consult with a qualified mental health professional if you have mental health concerns
• Seek immediate help if you are experiencing a mental health crisis
• Not rely on MindTune as a substitute for professional medical advice, diagnosis, or treatment
• Contact emergency services immediately if you are experiencing suicidal thoughts or thoughts of harming yourself or others
• Understand that AI-generated recommendations are for general wellness only

4. Account Registration
To use the Service, you must:
• Be at least 18 years old (or the age of majority in your jurisdiction)
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Not share your account with others
• Notify us immediately of any unauthorized use
5. User Responsibilities
You agree to:
• Use the Service only for lawful purposes and personal wellness
• Provide accurate information when checking in and tracking your mental state
• Not upload harmful, offensive, or inappropriate content
• Not attempt to reverse engineer, hack, or compromise the Service
• Not use the Service to harm others or violate their rights
• Respect other users in community features
• Not provide medical advice to other users
• Comply with all applicable laws and regulations
• Use the Service as a wellness tool, not as medical treatment
6. Subscription and Payment
Subscription Plans:
• MindTune may offer free and paid subscription tiers
• Subscription fees are billed in advance on a monthly or yearly basis
• Prices are subject to change with 30 days notice
• Payment is processed through App Store or Google Play in-app purchases
• All fees are non-refundable except as required by law or platform policies
• Free trial periods may be offered to new users
• Some features may be limited to premium subscribers
7. Cancellation and Refunds
You may cancel your subscription at any time. Upon cancellation:
• You will retain access to paid features until the end of your current billing period
• No refunds will be issued for partial billing periods
• Your data will be retained according to our Privacy Policy
• You may reactivate your subscription at any time
• Downloaded meditation sessions may remain accessible offline
Refund exceptions:
• Technical issues preventing Service use (evaluated case-by-case)
• Accidental duplicate charges
• As required by applicable consumer protection laws
8. Intellectual Property
Service Content:
• All content, features, and functionality of MindTune are owned by Y7 Technology LLC
• This includes software, algorithms, AI models, audio content, guided meditations, text, graphics, logos, and trademarks
• You may not copy, modify, distribute, or create derivative works without permission
• Downloaded meditation sessions are licensed for personal use only
User Content:
• You retain ownership of content you upload or create
• By using the Service, you grant us a license to process and analyze your data to provide Service features
• We do not claim ownership of your personal mental health data
• You may delete your content at any time
9. Data Usage and Privacy
Your privacy is important to us. Please review our Privacy Policy, which explains:
• What data we collect and why
• How we use, store, and protect your mental health data
• Your rights regarding your personal information
• Third-party integrations and data sharing
• Compliance with GDPR, CCPA, and other privacy laws
• Special protections for sensitive mental health data
Data Security:
• We implement industry-standard security measures
• Mental health data is encrypted in transit and at rest
• We conduct regular security audits
• However, no system is 100% secure, and you use the Service at your own risk
10. Third-Party Integrations
MindTune may integrate with third-party services and devices:
• Apple Health, Google Fit, and other health platforms
• Wearable devices (smartwatches, fitness trackers)
• App Store and Google Play for payment processing
• Social media platforms (for optional sharing)
You acknowledge that:
• Third-party services have their own terms and privacy policies
• We are not responsible for third-party service performance or data handling
• Integration may be discontinued at any time
• You authorize data exchange between MindTune and connected services
11. Community Features and User Conduct
If you participate in community features, you agree to:
• Treat all users with respect and kindness
• Not provide medical advice or mental health treatment recommendations
• Not share personal health information that could identify others
• Not post harmful, triggering, or distressing content
• Report inappropriate content or behavior
• Understand that community features are for support, not therapy
• Not use community features for commercial purposes
We reserve the right to:
• Remove content that violates these Terms
• Suspend or terminate accounts that engage in harmful behavior
• Moderate discussions to maintain a safe environment
12. Service Modifications and Termination
We reserve the right to:
• Modify, suspend, or discontinue any aspect of the Service
• Change features, functionality, or pricing with notice
• Update meditation content and AI algorithms
• Refuse service to anyone for any reason
• Terminate accounts that violate these Terms
Upon termination:
• Your right to use the Service immediately ceases
• We may delete your account and data after a reasonable retention period
• You may request a data export before deletion (subject to technical feasibility)
• Downloaded meditation sessions may become inaccessible
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
We are not liable for:
• Indirect, incidental, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Mental health outcomes or decisions based on the Service
• Emotional distress or psychological harm
• Inaccuracies in AI-generated recommendations
• Third-party service failures or data breaches
• Unauthorized access to your account due to your negligence
• Content posted by other users in community features
Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.
IMPORTANT: This Service is for wellness purposes only. We are not liable for any harm arising from:
• Reliance on the Service instead of professional mental health care
• Decisions made based on AI recommendations
• Participation in meditation practices
• Use of the Service during mental health crises
14. Indemnification
You agree to indemnify and hold harmless Y7 Technology LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of third parties
• Mental health decisions made based on Service data
• User content you upload or share
• Your participation in community features
• Your interactions with other users
15. Dispute Resolution
Informal Resolution:
Before filing a claim, you agree to contact us at support@y7technology.com to attempt to resolve the dispute informally for at least 30 days.
Arbitration (if applicable by jurisdiction):
Any disputes that cannot be resolved informally shall be resolved through binding arbitration, not in court, except where prohibited by law.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan, without regard to conflict of law principles.
For users in Japan:
• Disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court
• Japanese consumer protection laws apply where applicable
For users in the EU:
• GDPR rights apply as specified in our Privacy Policy
• Nothing in these Terms limits your statutory consumer rights
For users in California:
• CCPA rights apply as specified in our Privacy Policy
17. Changes to Terms
We may update these Terms from time to time. Changes will be effective:
• Immediately upon posting for non-material changes
• 30 days after notice for material changes
• Upon your continued use of the Service after changes
We will notify you of material changes via:
• Email to your registered address
• In-app notification
• Notice on our website
Your continued use after changes constitutes acceptance of the new Terms.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
